Below, you’ll find answers to some of the most frequently asked questions to help shed light on the conveyancing process.

Put simply, conveyancing is an area of law that deals with the preparation of documents for the transfer of a property from a seller to a buyer.

Conveyancers are responsible for ensuring that clear title to property is passed from a seller to a buyer. They are specially trained to handle the property transfer process. Conveyancers will generally prepare, verify and lodge the various legal documents required for the transfer of a property and attend settlement for you. On the face of it, conveyancing seems easy but in reality it involves numerous steps, tasks and documents, all of which must be coordinated in a timely manner to achieve settlement.

Absolutely. At One80 Conveyancing, the entire process can be completed online. However, if you prefer to attend our offices than that is alright too.

Generally, the real estate agent will prepare the sales contract. You should read the sales contract carefully to make sure you understand your rights and obligations. At One80 Conveyancing we offer a complimentary contract review, we take the time out to review your contract and explain your contract to you in plain language. We also highlight any risk clauses and proposes amendments to those risk clauses, where appropriate. If required, we can draft special conditions for you.

PEXA is an online settlement process. This can be used to settle matters without the need for either party to meet and exchange documents and bank cheques. The entire process is electronic which means the seller gets paid quicker and the buyer gets the property in their name quicker.

In Queensland, contracts have a cooling-off period of five days in which the buyer can legally cancel the contract. If you choose to exercise your right to cancel the contract during the cooling off period, the seller may be entitled to deduct 0.25% of the purchase price from the deposit.

The most important thing to know about buying at auction as opposed to private treaty is that the sale is unconditional. That means the cooling off period does not apply. This therefore means that as a buyer you must be fully prepared – you must have pre-approved finance or funds available and you must be satisfy yourself with the condition of the property before the auction.

The cost of conveyancing varies from provider to provider. As with all things, you get what you pay for. Be sure to carefully consider your quote and ask yourself these questions:

  • am I get added value?
  • what is included in the price that I have been quoted?
  • Is my quote a fixed fee?
  • Does my quote include searches? If so, what searches does my quote include?
  • Do I have the option of having the conveyance process done online?

In Queensland, the standard contract is the Real Estate Institute of Queensland Contract (REIQ) contract. This is a standard form contract with general terms and conditions. The REIQ standard form contract can be amended by way of special conditions. Special conditions are additional clauses that are added to a standard contract. Special conditions are designed to address items that are not included in the general conditions or your specific circumstances.

This depends on several factors, such as:

 

  • the State or Territory you buy in
  • the price of the house you buy
  • whether you are entitled to any exemptions

The buyer pays transfer duty.

Transfer duty is a tax a buyer pays when buying a house. The amount of the transfer duty is dependant on the price of the house that is bought.

The conveyancing process usually begins once a contract has been signed and ends at settlement. The time period between contract signature and settlement will depend on the terms of the contract. For example, unconditional contracts can settle much quicker than conditional contracts (those contracts that are subject to finance and building and pest inspection). In Queensland, settlement is usually 30 to 45 days from the date of the contract.

In Queensland, time is of the essence in contracts for the sale of land. It essentially requires the timely completion of a task. This means that if there is a failure to complete a task or satisfy a condition on or before the nominated date, the other party will have certain rights (such the right to terminate a contract) against the defaulting party.

Yes, searches are necessary. Conveyancing searches provide up to date information on the property you are buying. The information contained in searches is not always included in the contract. You may have a right to terminate a contract, where searches reveal information that is not disclosed in a contract. Further, some searches such as water and council rate searches are essential for settlement – an update search is required so any adjustments can be made to settlement figures.
